Article 59a. § (1) If, before the commencement of the trial proceedings in the first instance, the perpetrator, who has not previously been convicted of a violent intentional crime, has repaired the damage or made reparation for the harm caused, the criminal proceedings for a misdemeanor punishable by a term not exceeding 3 years' imprisonment, as well as for a misdemeanor against property punishable by a term not exceeding 5 years' imprisonment, as well as for a misdemeanor defined in Article 157 §.
In a situation where, legal assistance is to be provided to a person against whom temporary custody has been applied, or is already serving a sentence of imprisonment - there is a possibility of submitting a substitute statement of authorization of defense to attorneys from the Lawyer's Office, by the closest family members. On the basis of such authorization, the lawyer will be given the opportunity to see the inmate, during such a visit it will be possible to obtain a "proper" signature - directly from the client.
How can legal assistance be provided to those in temporary custody - or serving a sentence ?
Consensual remission of criminal proceedings - Article 59a of the Criminal Code. How to use it ?
In a situation where the client has a writ of execution, and the opposing party does not fulfill its obligation - there remains the possibility of referring the case to enforcement. The Law Firm also represents its clients at the enforcement stage. The participation of a lawyer in such proceedings ensures that the application is correctly formulated and all methods of enforcement are indicated in it - which translates into the effectiveness of such proceedings.
I have a relevant judgment - provided with an enforcement clause, but the debtor does not want to voluntarily make payment.
